§ 30-171. Legislative intent.

  • (a)

    The village council is aware of the adverse effects of tobacco use to the public health, especially as it relates to children, elders, and those with lung disease within the village;

    (b)

    The village council has determined that it is in the best interest of the village to ban the use of tobacco products at certain outdoor village owned facilities where the use of tobacco products is most likely to affect susceptible individuals adversely;

    (c)

    The village is granted proprietary powers as provided in F.S. § 166.021(1);

    (d)

    The village council has a proprietary interest, as well as a governmental interest, in the outdoor facilities described herein, including the village owned parks and outdoor recreation facilities; and

    (e)

    The village council is not regulating smoking indoors as proscribed in F.S. § 386.209, but rather is regulating outdoor use of tobacco products on village owned real property.
