§ 58-17. Contracting authority in general.

  • (a)

    The village may execute a purchasing contract/purchase order with any person or entity selected in accordance with this purchasing code.

    (b)

    No village contract, or any contract change order, may be enforced against the village unless the contract or change order is in writing, and duly executed by the village in accordance with this purchasing code.

    (c)

    Contract change orders: Every contract amendment, addendum, modification, change order, or contract price or term adjustment ("change order") shall be subject to prior approval by the village manager or council as follows:

    (1)

    The village manager may approve a change order if the cumulative change order amount does not exceed $25,000.00 and there is no change in the scope of work or time for completion; provided that, the change order amount is available to the user department. Once the cumulative change order amount exceeds the village manager approval threshold as stated herein, all future change order(s) must be approved by the council.

    (2)

    Council approval of a change order is required if the cumulative amount of the change order (including any prior change order(s) approved by the village manager) is more than $25,000.00 over the approved contract award value.

    (3)

    Any change order that will require a formal budget amendment or budget transfer may not be approved until the budget amendment/transfer has been approved by the council.
