§ 58-19. Enforcement of purchasing code.

  • Non-criminal violations . A non-criminal violation is one in which there is no apparent intent to avoid or fail to comply with this purchasing code. All village employees are subject to discipline as provided in the village's employment regulations for non-criminal violations of this purchasing code.

    Criminal violations . A criminal violation is one in which there is an intentional violation of this purchasing code resulting in, attempting to result in, or conspiring to result in significant loss to the village, having a monetary value of more than $100.00, or the commission of any other federal or state crime relating to purchases or acquisitions by employees, department directors, village manager or village elected officials. Such person may be charged with an appropriate misdemeanor or felony, and in addition may be disciplined as provided in the village's employment regulations. If a violation requires further investigation to determine if it is criminal in nature or to determine probable cause, a private investigator, the police chief (if not involved), the county sheriff, the Florida Department of Law Enforcement (FDLE) or the Federal Bureau of Investigation (FBI) may be requested by the village manager (if not involved) to investigate the violation, and make a report to the village manager and/or council stating whether the violation should be referred to the appropriate law enforcement or prosecutorial agency for filing as a criminal matter.
