§ 66-65. Duty to notify village of resellers; conditional use of public rights-of-way.

  • Within 30 days of any registered communications services provider using its facilities to carry the communication services of any reseller, such communications services provider shall notify the village of the name and address of such reseller. A reseller's lease, interconnection or other use of facilities belonging to a communications services provider duly registered in accordance with section 66-62 and properly permitted to place or maintain its facilities in the public rights-of-way, does not, and shall not, afford such reseller any right, claim or cause of action to impede the lawful exercise of the village's rights or police powers, including, but not limited to, requiring the registered communications services provider to remove such facilities from the public rights-of-way.
