§ 74-36. Fines.

  • (a)

    Each owner of a motor vehicle, who has affixed to the motor vehicle a notice of citation for violation of the restrictions on stopping, standing or parking under the provisions of this article, may pay to the village clerk the following penalties for and in full satisfaction of the violation:

    If paid prior to issuance of a notice to appear (not earlier than 48 hours after the violation) If paid along with a waiver of court appearance within five days of notice being mailed to the violator by certified mail
    Illegal parking in spaces designated as reserved for disabled persons $100.00 $250.00
    All other violations   20.00   40.00

     

    (b)

    If the owner shall fail to pay the penalty provided in subsection (a) of this section within five days after notice, a summons may be issued ordering and directing his appearance at the county court. If the owner is found guilty of the violation in county court, the owner shall be fined a minimum of $50.00, except for violation for parking in space reserved for disabled persons which shall be $250.00 per violation.

    (c)

    The village clerk shall supply the state department of highway safety and motor vehicles with a magnetically encoded computer tape reel or cartridge, which is machine readable by the installed computer system at the department, listing persons who have three or more outstanding parking violations. In addition, the village clerk shall supply the clerk of the court with the names, addresses and other identifying information of persons who have one or more outstanding parking violations for spaces designated for use by disabled persons.
