§ 10-58. Applications for building permits; owner-builder permits.

  • (a)

    The village will only accept applications for a building permit under this section, from a properly registered or licensed firm, partnership, corporation, business trust, or other legal entity, or independent certified individual, who is certified as qualifying agent by the village, the county, or the state. Qualifying agents are equally and jointly responsible for the supervision of all operations of the business organization.

    (b)

    The village may accept owner-builder permit applications for repairs and construction work for detached single-family residential buildings which are not offered for sale or lease. Persons issued an owner-builder permit pursuant to this subsection, shall be solely responsible for providing all labor, materials, and supervision of the work. An owner-builder permit shall only be issued to an applicant who personally appears at the village building department with proper identification, and signs the permit application under oath.

    (c)

    Owner-builder permits may be issued by the village for the following types of construction:

    (1)

    Fences constructed of wood, wire, metal, plastic, masonry, and concrete;

    (2)

    Sheds constructed of metal or wood, not exceeding 100 square feet of flooring;

    (3)

    Replacement of doors, windows and cabinets;

    (4)

    Enclosure of porches and carports and additions thereto of 500 square feet or less;

    (5)

    Repairs or alterations of interiors;

    (6)

    Replacement of fascia and siding;

    (7)

    Repair of roof leaks;

    (8)

    Replacement of roofs not requiring "hot mopping" or "torch down";

    (9)

    Minor construction and repairs that require a permit and are approved by the village building official;

    (10)

    Installation of protective devices for glazed openings.

    An owner-builder permit for work other than the types listed in subsections (c)(1) through (10) may only be issued by the village building official, after the building official determines that the applicant is sufficiently qualified, competent, and possesses sufficient knowledge and expertise to perform the proposed work, and that the work to be performed is not encompassed within the provisions of the state building code (i.e., painting), or that special circumstances apply to the particular application that warrant issuance of a permit. The building official may examine (orally and/or in writing) any applicant for an owner/builder permit, to determine whether the applicant is sufficiently qualified to perform the proposed work. The failure of an owner-builder permit applicant to submit to such a competency examination by the village building official is just cause for denial of the permit application by the village.

    (d)

    The denial of an application for a building permit pursuant to this section may be appealed to the village construction board of adjustment and appeals.

    (e)

    All applications for permits shall be sworn under oath. In the event there is a change(s) in any material fact stated in the attested permit application, the permit holder must immediately file an amended and attested permit application, detailing all changed facts and conditions. If the change is in the identity of the permit holder, the owner shall immediately cause the cessation of all work and shall give written notice to the village building official of the change. The work may not be resumed, unless and until, a new attested application is filed with the village and a new permit is issued. If the changed conditions are determined by the building official to be in compliance with this chapter, and other applicable codes and ordinances, and are no greater than those permitted under the original permit, an amended permit will be issued, subject only to such fees and charges as may be applicable to amending a permit or transfer of a permit to a new permit holder.

    (f)

    Separate permit applications are required for:

    (1)

    Each separate, independent building or structure, regardless of the number of buildings in the project.

    (2)

    Each accessory or common use facility, separate from the main use building, sidewalks and driveways.

    (3)

    Two or more interdependent main buildings and their common use facilities, which are to be constructed in one continuous operation.

    (g)

    Owner-builders may submit subcontractor permit applications for all subcontracted work for which a permit is required, at the time that the building permit application is submitted. However, permits for projects (other than new commercial and new residential construction projects) will not be issued, until all subcontractor permits have been approved for issue by the village together with the main permit for the project. For single-family additions and alterations, all subcontractor permits, except for roofing permits, must be obtained prior to approval of the main permit.
